Protecting Texas Businesses from Unfair Litigation

Today, every Texas industry is facing the threat of abusive lawsuits. Runaway lawsuits are placing Texas businesses of all sizes, across all sectors in an extremely tenuous position. Texas job creators are being forced to raise prices, lay off employees or close their doors – ultimately harming the Texans these businesses serve every day. The abuse must stop.

LSEA Urges Texas Lawmakers to Pass SB 30/HB 4806

Meaningful reforms in Senate Bill 30 by Sen. Charles Schwertner (R-Georgetown) and companion House Bill 4806 by Rep. Greg Bonnen (R-Friendswood) will help restore transparency and fairness to Texas’s courts. Specifically, SB 30/HB 4806 includes reforms that will (1) encourage doctors to treat accident victims; (2) stop the manipulation and inflation of medical damages; and (3) educate jurors on noneconomic damages by providing clear standards and definitions.

These are essential principles in SB 30/HB 4806 – which will help ensure employers can continue to create jobs and safely provide the goods and services that are essential to Texas families:

  • Require agreements between plaintiff’s lawyers and healthcare providers to be disclosed.
  • Promote medical bill transparency and tie medical bills to real-world payments as reflected in the AllPayors Claims Database.
  • Give jurors understandable definitions of pain and suffering as well as mental anguish to prevent misuse of awards.
  • Require unanimous jury decisions about the amount of noneconomic damages.
  • Allow defendants to request a reduction of the jury’s award after trial and require trial judges to explain unusually high awards.
  • Prevent attorneys from “anchoring” (i.e., suggesting amounts of noneconomic damages based on objects, values, or metrics with no connection to the facts).

LSEA Day at the Texas State Capitol

Members of the Lone Star Economic Alliance converged at the Texas State Capitol on March 11 to urge Texas lawmakers to pass meaningful reforms in SB 30/HB 4806 that will put an end to the unfair litigation tactics threatening Texas’s prosperous economy – the eighth largest in the world. Nearly 1,150 Texas businesses, individuals and businesses associations comprise LSEA, representing critical industries including transportation, agriculture, construction, finance, food and beverage, home services, housing, law, medical supplies, and oil and gas.
